These Terms of Use ("Terms") govern access to and use of emonster.dev, SubmitCheck information and software made available by emonster inc. ("emonster", "we", "us", or "our"), and related support and services (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Product scope and review outcomes
SubmitCheck is intended to identify detectable pre-submission risks using a selected ruleset and the data available to it. Results do not guarantee App Store approval, review timing, legal compliance, runtime correctness, or the absence of other issues. Apple may reject an app for issues SubmitCheck cannot inspect or predict.
SubmitCheck is not affiliated with, endorsed by, or certified by Apple. Apple makes all App Store review and distribution decisions. Apple documentation and services remain subject to Apple’s own terms.
Use of the Services
You may use the Services only for lawful purposes and in accordance with these Terms. You are responsible for the artifacts, metadata, credentials, and other information you process; for reviewing sanitized evidence before upload; for the accuracy of your submission; and for complying with applicable laws and third-party agreements.
You may not misuse the Services, attempt unauthorized access, interfere with operation, submit malicious or unlawfully obtained material, bypass technical or entitlement controls, scrape or harvest content without permission, infringe intellectual property rights, or use the Services to harm emonster or others.
Accounts, purchases, and product terms
When paid or account features become available, checkout, taxes, refunds, subscriptions, and payment records may be handled by a payment provider and will also be subject to that provider’s terms. Product-specific checkout terms, fair-use limits, rescan windows, and deletion controls shown at purchase or in the product will supplement these Terms.
Intellectual property and feedback
The Services, including software, rules, reports, designs, text, graphics, code, product names, logos, inventions, and related content, are owned by emonster or its licensors and protected by law. Except as expressly allowed by a license or written agreement, you may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the Services.
If you send feedback, bug reports, or suggestions, you grant emonster a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or obligation to you.
Third-party services and sources
The Services may link to Apple, app stores, payment providers, hosting services, and other third parties. emonster is not responsible for their availability, accuracy, terms, policies, or practices. A link to an Apple source does not make SubmitCheck an Apple service.
Disclaimers and limitation of liability
The Services are provided "as is" and "as available". To the maximum extent permitted by law, emonster disclaims all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and security.
To the maximum extent permitted by law, emonster will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, failed submissions, review delays, or loss of goodwill. emonster’s total liability for any claim will not exceed the greater of the amount paid for the applicable Service in the three months before the claim or USD $100.
Changes, termination, and governing law
We may update, suspend, discontinue, or restrict access to the Services. We may update these Terms by posting a revised version here. These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, unless a separate written agreement states otherwise.
