This License Agreement ("Agreement") applies to SubmitCheck command-line tools, desktop software, downloadable components, updates, documentation, and related software made available by emonster inc. ("emonster", "we", "us", or "our"), unless a product-specific license or written agreement states otherwise. Software is licensed, not sold.
License grant
When emonster distributes software to you, and subject to this Agreement and any applicable purchase or entitlement terms, emonster grants you a limited, revocable, non-exclusive, non-transferable license to install and use it on devices you own or control for lawful personal, business, or internal use.
Restrictions
You may not copy, modify, adapt, translate, sell, rent, lease, sublicense, distribute, host, or create derivative works from the software except as expressly permitted by law, an open-source license, or written permission from emonster. You may not reverse engineer, decompile, disassemble, bypass technical protections or entitlement limits, remove notices, misuse APIs or data, interfere with service operation, or use the software for unlawful, harmful, or abusive purposes.
Ownership and open-source components
emonster and its licensors retain all rights, title, and interest in the software, documentation, designs, code, trademarks, inventions, and related intellectual property. Components distributed under an open-source license remain subject to that license, and its terms control if they conflict with this Agreement for that component.
Updates and availability
emonster may provide updates, fixes, ruleset changes, or new versions, but is not obligated to do so unless required by law or a separate agreement. Features may change, be suspended, or be discontinued. Some functions may require a compatible macOS version, internet access, App Store Connect availability, an active entitlement, or third-party services.
Privacy, credentials, and data
Information processed through SubmitCheck is handled according to the emonster.dev Privacy Policy and product disclosures. You are responsible for protecting your Apple credentials, reviewing sanitized evidence, and avoiding disclosure of secrets outside the documented schema. The software is designed not to upload raw app binaries or Apple API private keys to SubmitCheck servers.

No warranty and limitation of liability
The software is provided "as is" and "as available". To the maximum extent permitted by law, emonster disclaims all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and error-free operation. The software does not guarantee App Store approval or detect every possible submission issue.
To the maximum extent permitted by law, emonster will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, failed submissions, review delays, device failure, or loss of goodwill. emonster’s total liability for any claim will not exceed the greater of the amount paid for the applicable software in the three months before the claim or USD $100.
Termination and legal compliance
Your rights under this Agreement terminate automatically if you violate it. Upon termination, you must stop using and uninstall the applicable software and delete copies under your control. You are responsible for complying with export controls, sanctions, privacy, intellectual property, Apple developer terms, and other laws and agreements that apply to your use.
Governing law and contact
This Agreement is governed by the laws of the State of Washington, without regard to conflict-of-law principles, unless a separate written agreement states otherwise. Questions may be sent to [email protected].
